The House Ways and Means Committee voted to advance a bill, H.R. 9504, the Tax-Exempt Hospitals Transparency Act, that would add reporting requirements for nonprofit hospitals’ Schedule H IRS forms and add in new, extensive 340B reporting requirements that will cause compliance hardships.

While framed as an effort to increase transparency, these measures threaten to drown Nebraska health care providers in even more red tape at a time when they are already struggling under operational strain.

Hospitals are already among the most heavily regulated entities in the country, facing administrative burdens and intense compliance demands from all sides, including government, commercial insurance, and pharmaceutical companies. Piling on more complex IRS reporting requirements does nothing to improve patient care. In fact, it redirects staff time and financial resources away from the bedside and puts programs that improve access to care at risk. 

Lawmakers need to hear that compounding the regulatory bottleneck will only worsen health care affordability and further strain the workforce.
