BACKGROUND
The Regulatory Flexibility Act (RFA) was enacted to lessen the impact that federal regulations have on small business.

PROBLEM
A 2023 NFIB study found that agencies use loopholes in the RFA to underreport, minimize, or ignore the impact of regulations on small businesses.

SOLUTION
If passed and signed into law, the Small Business Regulatory Flexibility Improvements Act (SBRFIA) would stop agency abuse of the RFA by:

  • Strengthening the requirements for agencies to analyze the impact of regulations.
  • Increasing opportunities for small businesses to engage in the rulemaking process.
