Legal Reminder: Federal Odometer Disclosure Changes Took Effect January 1st

The National Highway Traffic Safety Administration (NHTSA) amended its odometer disclosure requirements under the Truth in Mileage Act effective January 1, 2021. Prior to January 1, 2021, a vehicle that was 10 years old or newer needed to have its mileage recorded at the time of titling. Starting January 1, 2021, odometer disclosure will be required for 20 years for all 2011 model year and later vehicles. Failure to properly record the milage will result in the title getting branded as "Not Actual Mileage" by the IL SOS. NHTSA's new rule will not apply retroactively to 2010 model year and older vehicles that became exempt from disclosure requirements before January 1, 2021 and will phase in one year at a time for 2011 and later model years.

The universe of vehicles that are subject to mileage disclosure has expanded, but the permissible methods for mileage disclosure HAVE NOT CHANGED. You may continue to disclose mileage for covered vehicles in any of the following ways:
- Disclose mileage on the Certificate of Title;
- Disclose milage on the Secure Power of Attorney (Red and White); or
- Disclose mileage on an Odometer Disclosure Form.
Also starting with transfers made on or after January 1, 2021, dealers will be required to retain odometer disclosure records for 5 years after the date of transfer. A link to NHTSA's new rules can be found here.
