Shortly after IADA sent out our Legislative Update on reporting EV Sales to IRS, we received the following message from NADA regarding potential security flaws in the IRS reporting portal.  Until further notice, it is recommended that dealers delay reporting of 2023 EV sales while we await clarification from IRS. 

NADA Recommends Dealers Delay Submitting 2023 Clean Vehicle Sales Reports

Yesterday, NADA sent an all-member email informing dealers of IRS guidance regarding the submission of 2023 clean vehicle sales reports. The process outlined by the IRS appears to raise possible privacy and data security concerns because it involves the submission of documents containing sensitive customer data to a potentially unsecure IRS email address. 

The IRS is aware of this issue, and we are awaiting further guidance, which we expect shortly. Until then, we recommend dealers delay the submission of 2023 sales reports, which currently has a deadline of Jan. 31, 2024, until this issue can be resolved.

IRS Provides Guidance for Reporting 2023 EV Sales 

The IRS just released guidance for dealers to report EV sales made during 2023 to the Secretary of the Treasury and extended the reporting deadline.  Key parts of the IRS guidance for reporting 2023 sales are as follows: 

  • Submit copies of your seller reports provided to eligible buyers via email to the following email address:  IRS.Clean.Vehicles.Seller.Reporting@IRS.gov
  • The IRS preferred format for these submissions is an excel spreadsheet containing all required data from all seller reports a seller or dealer prepared in calendar year 2023.
  • Sellers or dealers may also submit individual seller report copies of the Form 15400 or equivalent forms containing all required data the seller/dealer used in calendar year 2023.  Sellers and dealers that used reasonable alternatives to Form 15400 in providing the required seller reports to buyers do not need to prepare the information in the Form 15400 format.

Importantly, IRS extended the deadline for reporting 2023 EV sales from January 15, 2024 to January31, 2024.  Additional details about EV sale reporting can be found on the IRS website at: Clean vehicle credit seller or dealer requirements | Internal Revenue Service (irs.gov)

 

IRS “Office Hours” for 2024 EV Sales

IRS has also announced virtual “Office Hours” for dealers to register for help with time of sale reporting for sales made during or after calendar year 2024.  Information about IRS “Office Hours” can be found here:
