  LEGAL REMINDER: ELECTRONIC REGISTRATION AND TITLE FEES  
 
If you use an Electronic Registration and Titling (ERT) Program to electronically process vehicle titles and registrations, please remember that you cannot charge your customer a fee that exceeds the amount actually charged by the ERT Service Provider plus an amount equal to 1.5 times the amount actually charged by the ERT Service Provider.  Furthermore, the maximum fee that you can charge to a customer for electronically processing his or her title and registration is capped, by rule, at $25.  If you process vehicle titles and registrations directly through the Secretary of State’s website (PERT System), you are not permitted to charge an ERT fee to your customers. 
 
If you charge an ERT fee, you must use one of the following methods to identify the fee:
 
(1) You may identify the fee on the bill of sale, receipt, or other sales documents at an “Optional ERT Fee” using bold type, 10 point or larger; or
 
(2) You may identify the fee on a separate document, using the phrase “Optional Electronic Registration Fee” using at least 10 point font and include a signature line indicating the customer’s acceptance or rejection of the fee.

LEGAL REMINDER: FACTORY AUDITS
If your manufacturer schedules a warranty audit or an incentive audit, be sure to remember that Section 6(b) of the Motor Vehicle Franchise Act limits the factory’s look-back period to one year from the date the claim was paid.  The only exception to the one-year limit is that the manufacturer can charge back any fraudulent claim if it establishes fraud in a court of competent jurisdiction.   IADA has heard that at least one manufacturer is aggressively auditing its dealers, so be sure that you understand your Franchise Act rights if manufacturer auditors call on your dealership.   Section 6(b) of the Franchise Act can be found here: If you have any questions about factory audits or any other dealer rights under the Motor Vehicle Franchise Act, please contact IADA at (217) 753-0220 or at ldoll@illinoisdealers.com. 
 
 
LEGAL ALERT: CORVETTE ALLOCATION
Recent Automotive News articles have indicated that General Motors will limit initial allocation of the 2014 Corvette to dealers who sold at least 4 Corvettes in 2012.  Chevrolet dealers who are unable to order the new Corvette, as well as any other dealer who cannot obtain new vehicle inventory, is reminded that subsections (d)(1) and (d)(3) of the Motor Vehicle Franchise Act prohibit a  manufacturer from implementing a distribution of new vehicle that is arbitrary or capricious and from refusing to deliver reasonable quantities of vehicles covered by a dealer’s franchise agreement within a reasonable time after receipt of a dealer’s order.  Subsections (d)(1) and (d)(3) of the Franchise Act can be found here.
