South Dakota: Education Property Tax Credit (S.B. 190)

On February 3, 2025, S.B. 190 was introduced which establishes an education property tax credit program.

The property tax credit is available to any property owner for expenses incurred for a qualifying child.

To qualify, the child must be between 5-18 years old and either enrolled in a nonpublic school or be receiving alternative instruction.

The bill does not provide for a set credit amount.  Rather, the amount of the credit is restricted in two ways.  First, the tax credit may not exceed the total amount of school district taxes owed to that school district.  Second, the tax credit may not exceed 80% of the current year's per student equivalent in the general state aid education formula.

Section 3 of the bill sets forth a basic process to follow in order to receive the credit.
