AB 1825 will allow materials with sexual content to make their way into public libraries across the state, if they are not already in it. The bill will prohibit the governing body of a public library to use their own discretion and the community's opinion when prohibiting materials from library circulation.
AB 1825 states, “The discretion to determine the content of materials in public libraries shall not be exercised in a manner that discriminates against or excludes materials… on the basis that the materials may include sexual content, unless that content qualifies as obscene under United States Supreme Court precedent.” This language will allow materials that contain sexual content into library circulation, unless they are deemed to not have “serious literary, artistic, political or scientific value.”
AB 1825 also prohibits libraries from restricting access to library resources solely because of a person’s age. The bill states, “A person’s right to use a public library and its resources shall not be denied or abridged solely because of personal characteristics, age, background, or views.” If passed, libraries will effectively allow children to access materials with sexual content in public libraries.
