Support Expansion of the Fair and Open Competition Act
Critical legislation is moving through the Texas Legislature that will directly impact your ability to compete fairly for publicly funded construction projects. These bills, HB 1951 & SB 925, expand on the success of the 2019 Fair and Open Competition Act (HB 985) that prohibited government-mandated project labor agreements on state construction projects. The expansion will prohibit local governments—cities, counties, and school districts—as well as projects participating in federal matching programs from requiring contractors to sign a PLA to bid on or be awarded public construction contracts.

This effort will ensure ALL qualified contractors can compete for projects funded by their own local tax dollars. It will protect merit shop contractors from discrimination, level the playing field, and further reinforce a cost-efficient and responsible procurement process that protects taxpayers and the construction industry as a whole.
