Tell Your Members of Congress to Co-Sponsor the Fair and Open Competition Act
On March 14, Senator Todd Young, R-In., and Representative Clay Higgins, R-La., issued press releases, announcing the introduction of H.R.2126/S.1064, the Fair and Open Competition Act in the 119th Congress. Notably, seventeen Senators and 90 Representatives joined Sen. Young and Rep. Higgins in reintroducing FOCA, marking the highest number of original cosponsors in the bill's history.

FOCA will protect federal and federally assisted construction contracts from government-mandated project labor agreements and will allow merit shop contractors to have a fair chance at competing to build and rebuild America.

On Jan. 9, ABC led 24 construction and business groups in a letter to President Donald Trump in opposition to President Joe Biden’s Executive Order 14063 and subsequent final rule, Use of Project Labor Agreements for Federal Construction Projects, mandating project labor agreements on federal construction projects worth $35 million or more. 

In addition to participating in direct political advocacy to your members of Congress, please note that, by taking action on this alert, the name of your ABC member company will be used on a sign-on letter to Congress and the president so ABC will be able to better advocate for FOCA and against government-mandated PLAs.
