Protect the Local Preemption Law

Senate Bill 1173 and House Bill 6218, currently under consideration in the Michigan Legislature, would alter the ‘local preemption law’ that prevents local units of government from enacting their own rules and regulations on job providers and employees. This policy will have unintended consequences and benefit the few at the cost of many, including having a possible impact on population growth harming our positive business climate.

What Does SB 1173/HB 6218 Do:

  • Singles outs the construction industry while leaving the rest of the local preemption act intact.
  • Allows local units of government to impose requirements including making their own apprenticeship rules, prevailing wage laws and project labor agreement requirements.
  • Giving Michigan’s 1,800-plus local units of government permission to enact their own complex wage requirements would create inconsistency, confusion, and a bureaucratic, red-tape nightmare for business owners and employees across the state.
  • Could create “high-cost islands” across Michigan, limiting community access to jobs and necessities, reducing incentives to invest in the communities that adopt them, and, ultimately, discouraging population and economic growth in our state.
  • Discourages businesses from expanding to other areas due to differing wages requirements across the state.
