Victims of human trafficking are often compelled to commit crimes under force or coercion. Instead of receiving protection, many are arrested, prosecuted, and left with criminal records that follow them long after the exploitation ends — blocking access to jobs, housing, education, and even the right to vote.

This legislation creates a survivor-centered pathway to justice.

 HB 373 allows individuals charged or convicted of non-violent offenses that resulted from human trafficking to petition the court to vacate convictions and expunge their records at any time after final judgment. Courts are required to grant relief when evidence shows the offense was a result of trafficking, and records are sealed during review to protect survivors from ongoing harm.

By removing unjust criminal records and restoring fundamental rights, this bill helps survivors rebuild their lives, supports long-term stability, and ensures Kentucky’s justice system holds traffickers — not victims — accountable.
