More than half of the members of the House of Representatives have signed on as co-sponsors, which tells us it is a sure thing to pass if it is brought to the floor. It has well over 51 votes in the Senate, and President Biden will sign it.
Here's the problem -- The Speaker of the House controls what bills come to the House floor for a vote, and he won't do so for the LRFA.
Now, the Speaker isn't all powerful -- the full body of the House has a say through a process called a discharge petition. Simply put, if a majority of the House signs a discharge petition to bring the LRFA to the floor for a vote, the Speaker must let it happen.
This isn't always easy -- to sign this petition is to defy the Speaker, which may have negative consequences, especially if one is in the Speaker's party. So we need to make clear to our Congresspersons that the LRFA is important enough to sign on to the discharge position, come what may.
The LRFA will codify the Olmstead Supreme Court decision, that people are entitled to be in the most integrated setting, as a federal statute that the courts must abide by. As of now, it's judge-made precedent, and what judges make, judges can un-make.
Our rights need statutory protection, or we may well lose them! Please contact your Representative in the House and implore him/her to sign the discharge petition.
