It's no secret that rogue state legislatures nationwide are determined to regulate supplements like alcohol and tobacco. Draconian state laws, like the recently enacted law in New York, will force you to prohibit selling supplements to certain consumers and require warnings for potential harms that simply do not exist. Inaccuracies like this create fear, spread confusion, and impose unnecessary and expensive regulatory burdens on manufacturers.
Legitimate risks must be taken seriously, which is why the FDA is the chief regulator of dietary supplements. Yet state laws threaten the existence of dietary supplements and establish standards that run counter to the FDA's. Congress must know that the industry supports commonsense legislation that preempts state governments from overstepping the FDA's regulatory authority over dietary supplements.
Tell Washington that you stand with all American consumers and demand dietary supplement laws preempt the states.
