This important legislation would help prevent businesses from being targeted by fraudsters who use ADA compliance as a means to scam businesses out of thousands of dollars by threatening legal action in exchange for out-of-court settlements. Not only does H.R. 620 protect businesses from frivolous lawsuits but it gives businesses time to address any potential infractions before legal or regulatory enforcement actions are taken.
If passed, H.R. 620 would require that any person seeking to bring a legal claim against a business for a violation of the ADA must provide written notice of the violation and specifically outline how that violation caused harm or failed to allow a disabled person access to a service or good. From the time a notice is received, businesses will have 60 days to provide written notice of the intended improvements that will be made in order to correct the violation, and 120 days to show "substantial" progress towards correcting the issue.
