Action Needed: Menu Labeling Floor Vote Tuesday!

Ask your Representative to Vote in Favor of H.R. 772!

Tomorrow, the House will vote on H.R. 772, The Common Sense Nutrition Disclosure Act. H.R. 772 is bipartisan legislation that would provide relief and common sense fixes to those supermarkets (20 or more locations operating under the same banner and offering similar menu items for sale) that are covered under the FDA Chain Restaurant Menu Labeling law. The bill has already passed in the House previously, but we need to have a strong vote again in order to put pressure on the Senate to take up the bill as well. With the menu labeling regulations set to go into effect on May 7, 2018, this is our last shot at achieving meaningful reforms before the regulation is implemented.

Some of the reforms in the legislation include:

  • Define menu board as the primary listing for the consumer as opposed to FDA's regulations which require everywhere the item is listed to be labeled.
  • Protect covered entities from frivolous lawsuits through private right of actions.
  • Establish a good faith threshold to ensure businesses aren't penalized for inadvertent human error.
  • Flexibility to those establishments that carry unique items at only one location.
