Shortly, legislative leaders will be deciding what PBM reform might look like, and ultimately deciding whether the Commonwealth will even have a chance of ANY PBM reforms.
NACDS RxIMPACT needs your help pushing for a PBM reform proposal authored by State Representative John Lawn (D-MA). This legislative solution would protect access to neighborhood pharmacies by regulating PBMs manipulation of drug pricing and pharmacy reimbursement. Reforms would also prevent PBM tactics that hinder patients’ access to needed medications.
As seen in this video, PBMs are driving up drug prices and forcing patients to use PBM-affiliated pharmacies while reimbursing pharmacies below their cost to buy and dispense drugs patients need. There is zero evidence backing PBMs claims that regulating PBMs manipulations in the commercial market will increase costs. Also, PBMs still rely on Federal Trade Commission (FTC) documents, though the FTC in July 2023 unanimously approved a statement "cautioning against reliance on prior advocacy statements and studies related to PBMs that no longer reflect current realities." The FTC wants to prevent prior statements from stalling federal and state reforms. Similar laws that were passed in New York, Washington, Oregon, Vermont, and West Virginia have not had any increases on premiums.
