Developments abound this week as our steadfast community continues to push for the advancement of important PBM reform policies to protect Americans on Medicare and Medicaid and the pharmacies that serve them. Beyond three PBM reform bills being advanced out of committee this week, we have learned another bill could be voted on by the ENTIRE U.S. House as early as Monday, December 11.
Yesterday, the bipartisan membership of the House Energy and Commerce Committee approved three pieces of legislation including important PBM reforms: (1) H.R. 5393 to require CMS to establish pharmacy quality measures in Part D and that includes important PBM transparency provisions; (2) H.R. 5385 to create reporting requirements for PBMs under Medicare Part D; and (3) H.R. 2880 to prohibit PBMs participating in Medicare Part D from linking their service fees to a drug's list price.
EVEN FURTHER, we have learned a full U.S. House vote on an amended Lower Cost, More Transparency Act (H.R. 5378) could take place as soon as MONDAY! The bill is a conglomeration of important House Energy and Commerce Committee and House Ways and Means Committee PBM reform provisions, including the broader PATIENT Act that advanced through the Energy & Commerce Committee in May. A full U.S House YES vote on this bill would prohibit “spread pricing” in Medicaid, establish a “pass-through payment” model and create a Medicaid managed care “rate floor” similar to that of Medicaid fee-for-service that focuses on cost-based pharmacy reimbursement and dispensing fees.
It is imperative to sustain momentum behind this crucial effort and advance PBM reform.
