Bill Summary
Senate Bill 199 provides that any pesticide registered with the Kentucky Department of Agriculture or the U.S. EPA under FIFRA, and bearing an EPA‑approved or FIFRA‑consistent label, is legally deemed a sufficient warning label for any state law claim concerning a duty to warn or label. It amends KRS Chapter 217 (and KRS 217.544) so that, except in narrow circumstances where EPA finds a company hid health‑risk information, pesticide manufacturers can use federal registration and labeling as a defense against Kentucky “failure to warn” lawsuits.

Why It Matters to the Make America Healthy Again Movement
The MAHA Movement does not support this bill because it effectively shields pesticide manufacturers from state‑level “failure to warn” claims by treating federal EPA labels as automatically adequate, even when emerging science or local harm suggests those labels understate cancer and other health risks. By turning EPA‑approved labels into a powerful liability shield in Kentucky courts, SB 199 undermines communities’ and farmers’ ability to hold chemical companies accountable and conflicts with MAHA’s commitment to stronger, not weaker, protections against toxic exposures.
