HB 1302 - Rep. Kelly Cassidy (D): favors criminals over victims and ties the hands of police officers. It amends four sections of the Illinois' Criminal Code.
- It repeals the 7-day retail theft notification requirement, thereby stripping the ability of retailers to prepare evidence for court proceedings: leading to critical evidence being withheld; uninformed victims being less likely to participate in court proceedings; and unreported theft if retailers perceive systemic neglect.
- It removes police discretion when investigating domestic abuse. Not all claims made by alleged victims are truthful. Why not use robots to enforce the law if police can't be trusted?
- It allows charges to be vacated if the person was a victim of sex trafficking. Cassidy wants to give a pass for any crime whatsoever—prostitution, theft, burglary, terrorism, battery, kidnapping, murder, whatever - if they were a victim of human trafficking.
- It removes more police discretion by prohibiting a police officer from discouraging a victim from filing a police report. Major crimes in Chicago are between 70,000-80,000. Does anyone think that 1,000 detectives can solve that many? Again, discretion is extremely critical.
