In South Dakota, libraries and other educational institutions are given an "affirmative defense" (i.e. an exemption) from the laws governing what material is harmful to minors. This means that content which is illegal for the average citizen to show to a child, is acceptable coming from a library or other educational institution.
HB1239 removes this carve-out, and ensures that these institutions are not exempt from our laws protecting minors from harmful content.
