The proposal, which will apply to PRIVATE CONSTRUCTION, will make general contractors and construction managers responsible for the unpaid wages and benefits of subcontractors, regardless of tier. As private construction doesn't have standard wage rates, this will be impossible to comply with. Employees or labor organizations will have the right to bring a civil suit against the contractor which could lead to hefty legal fees.
For subcontractors, this will create a requirement to submit certified payrolls to prime contractors on private construction jobs. It will increase administrative costs and force subs to divulge private payroll information that should remain between employer and employee.
The law will only cause pain for well-meaning contractors while failing to accomplish the goal of punishing the bad actors. This will lead to costly administrative burdens and an increase in frivolous civil litigation.
