The U.S. Department of Labor (DOL) has proposed a significant change in the overtime pay requirements under the Fair Labor Standards Act. While the intention to strengthen the nation's workforce is commendable, the potential repercussions without funding on community-based services for people with intellectual and developmental disabilities (I/DD) cannot be understated.

Community-based providers play a vital role in supporting individuals with I/DD to live in their homes and communities through services funded by Medicaid Home and Community-Based Services (HCBS). However, without funding the proposed rule could place an untenable financial burden on providers, jeopardizing access to these essential services. The Disability Community Act seeks to address this challenge by authorizing a Federal Medical Assistance Percentage (FMAP) increase for states for three years. This increase is crucial for community-based providers to meet the cost of compliance with the overtime rule, ensuring the continued delivery of I/DD services without compromising access.
